WITHIN THE SCOPE OF THE LAW ON PROTECTION OF PERSONAL DATA NUMBERED 6698

INFORMATION TEXT REGARDING THE PROCESSING OF PERSONAL DATA FOR PATIENTS/PATIENT RELATIVES

This Information Text has been prepared in order to inform the data subjects about the processing, storage, transfer, and destruction of personal data belonging to patients and their relatives who apply to Prof. Dr. Yavuz Kocabey Clinic (“Physician”) in accordance with the Law on Protection of Personal Data numbered 6698 (“KVKK”) and the General Data Protection Regulation (“GDPR”) of the European Union.

At Prof. Dr. Yavuz Kocabey Clinic, in accordance with the Law on Protection of Personal Data numbered 6698 (“KVKK”) and the General Data Protection Regulation (“GDPR”), personal data security of patients and their relatives is prioritized, and the privacy of private life and the protection of fundamental rights and freedoms are taken into consideration. In this regard, we would like to inform you about the purposes of processing your personal data, the legal reasons, the methods of collection, to whom they can be transferred, and the rights granted to you under both KVKK and GDPR (in terms of data transferred abroad).

What Personal Data Do We Process?

In accordance with the KVKK Article 4 and the GDPR Article 5, we process various personal data and special categories of personal data of our patients in order to provide healthcare services. These personal data will be processed in compliance with the Personal Data Processing Conditions and Purposes stated in Articles 5 and 6 of KVKK and Articles 6 and 9 of GDPR, and within the scope of the purposes specified in this Information Text; lawfully, in connection with the processing purpose, limited and proportionate, and with the implementation of all kinds of technical and administrative measures prescribed by the legislation for ensuring data security.

a- Your Identity Information: Your name, surname, Turkish ID number and/or passport number and/or Temporary Turkish ID number, patient protocol/registration number that can be personalized by Prof. Dr. Yavuz Kocabey, your date of birth, marital status, gender, and other identity data that can identify you.

b- Your Contact Information: Your address (residence/workplace), your phone number (your home/work fixed and/or mobile phone numbers that you provide), your email address.

c- Your Health Information: Your blood type, allergies, chronic diseases, hereditary and genetic diseases, infectious diseases, data related to previous surgeries/operations you have undergone, medications you regularly use, information about COVID-19 disease, your medical treatments, health reports, test and imaging results, prescription information, your health-harming habits, and other health data necessary for the treatment and medical practices to be applied to you.

d- Your Photographs and Video Images: Your photographs and/or videos taken before, during, and/or after medical procedures.

e- Your Financial Information: Your bank account number, IBAN number, billing and invoice information, private health insurance or Social Security Institution data, and other financial data.

For What Purposes Do We Process and Transfer Your Personal Data?


Your Personal and Special Categories of Personal Data mentioned above will be processed, recorded, classified, and anonymized if necessary (meaning the process of anonymizing personal data, even if they are matched with other data by masking, removing variables, generalizing, etc., they cannot be associated with an identified or identifiable real person) within the scope of the purposes specified in this Information Text; in order to fulfill our legal obligations stated in the Law on Basic Healthcare Services numbered 3359, the Law on the Practice of Medicine and the Arts of Medicine numbered 1219, the General Hygiene Law numbered

 

  1. How Personal Data is Collected and the Legal Basis for Such Collection?

    The methods of collecting personal data and the legal bases for such collection are as follows:

    1. Explicit Provision in the Law: Personal data may be collected if there is an explicit provision in the law that allows for such collection.

    2. Necessity for the Performance of a Contract: Personal data may be processed if it is necessary for the establishment or performance of a contract, provided that it is directly related to the parties of the contract.

    3. Protection of Vital Interests: Personal data may be processed without the data subject’s consent if it is necessary to protect someone’s life or bodily integrity, and the data subject is physically or legally incapable of giving consent.

    4. Compliance with Legal Obligations: Personal data may be processed if it is necessary for the data controller to fulfill its legal obligations.

    5. Legitimate Interests: Personal data may be processed if it is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

    6. Public Interest: Personal data may be processed for reasons of public interest in areas such as public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing.

    7. Consent: Personal data may be processed based on the explicit consent of the data subject for the purposes stated in the relevant Privacy Notice.

    It is important to note that personal data should be collected and processed in accordance with certain principles, including being lawful and fair, accurate and up-to-date, purpose limitation, data minimization, storage limitation, and ensuring data security.

    If you have any questions regarding your rights related to the processing of personal data, you can make a written request to Prof. Dr. Yavuz Kocabey according to the procedures and principles specified in the “Communiqué on Application Procedures and Principles to the Data Controller” Article 5, or you can use the registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the electronic mail address previously notified by you and registered in the data controller’s system.
